UAPA  The hypocrisy of CPI(M) on UA(P)A and Political Prisoners:

1)First Political Prisoner to be murdered by State in Custody after being slapped under UAPA in India is Comrade SwapanDas Gupta (Editor of People's March) of West Bengal. He was arrested and charged with UAPA by CPI(M) government led by Buddhadeb Bhattacharya.
2) First UA(P)A case in Kerala was registered by VS Achuthanandan's Government, Former CPI(M) Polit Buro Member and Former Chief Minister of Kerala) on Govindankutty (Editor of People's March) in 2007.
3) RTI query filed by Advocate Thushar revealed that the Pinarayi Vijayan government has not formed a review committee on UA(P)A cases even two years after announcing it.
4) Kerala State Police of Pinarayi Vijayan's First Term ( 25.05.2016 - 19.05.2021) Government has taken 145 cases under the, UA(P)A. Out of 145 cases, a Request for the Prosecution sanction of 8 Cases were given by the DGP of Kerala Police to the Statutory Authority formed for considering the cases for prosecution clearance. But only 3 cases were given sanctions.
5) Nahas and Sreekanth, State Secretary and President of Progressive Youth Movement were charged under UAPA. after puting up posters demanding action against police officers who murdered CPI Maoist Leader CP Jaleel, Judicial investigation on the fake Encounter and dissolving of the Thunderbolts, Elite Commandos for Anti Maoist Operations.
6) Comrade Lukman Pallikandy was arrested under UAPA for putting up a poster of Progressive Youth Movement in Kannur demanding punishment for the murderers of CP Jaleel and had to endure 65 days in jail after he was arrested under UAPA by Kerala Police. He was only bailed out by the intervention of the High Court not of the commission made for UAPA cases.
7) When the High Court of Kerala cleared three UAPA cases charged against Maoist leader Comrade Roopesh, Pinarayi Government countered against the quashing by Kerala High Court at Supreme Court.
😎 Comrade Rajeesh Kollakkandi was charged under UAPA after he protested against the Extra-Judicial murder of 2 Maoists in Nilambur in 2016.
9) 19-year-old Allan and 24-year-old Thwaha were charged under UAPA by Kerala Police for mere possession of Maoist literature.
10) Buddhadev Mahato was a student when he was arrested and charged under UAPA by the left government of Bengal. He's in his thirties now and is still in jail.
11) Buddhadeb Bhattacharya has publicly supported UAPA and has told that he would use UAPA if he's convinced. Pinarayi concluded that Allan Thaha were Maoists even before the trial started and through this, he was justifying the usage of UAPA by Police. These 2 incidents prove that CPIM has 2 different UAPA, good UAPA and Bad UAPA.
12) 67-year-old Political Prisoner, Comrade Ibrahim who is in jail for the last 6 years after being accused in a fake Maoist case under UAPA was not granted bail or parole by State Government in wake of Covid. Ibrahim has already suffered 2 cardiac arrests and is also an acute diabetic patient. He can't even eat the food properly and has his teeth removed due to poor health. The same CPIM is crying for Stan Swamy and other Political Prisoners imprisoned in other states.
13) Comrade Rajeevan who is accused as a Maoist had to protest for a Bar of Soap! In Kerala Jail, it's mandatory to wash hands in every hour. But prisoners are not given soap. Rajeevan protested against the jail authorities for not giving soap. Rajeevan's wife & Adivasi Leader, Comrade Thankamma called DGP and fired him. Rajeevan's protest was called off after soap was given to all prisoners but Rajeevan was shifted to Viyyur High-Security Prison for complaining.
This is Kerala & how the state treats the prisoners especially the Political Prisoners during the pandemic time.
14) CPI Maoist Leader Roopesh has complained against Viyyur High-Security Prison in Kerala for violating the "fundamental rights assured by the Constitution of India”. He pointed out that even CCTV are placed in toilets along with unnecessary cavity & body mass check.
15) After CPI Maoist Leader Danish got bail in all 14 cases registered against him in Kerala and Tamil Nadu, he was released from Viyyur High Prison cell after serving 2 years as an under-trial. But the moment he got released from the prison, he got rearrested by Kerala Anti-Terrorism Squad for an old case registered against him in Kerala. The Supreme court has said that when a person is in custody, all the cases registered against him should be brought before the court. The court will ask the prosecution if there are any other cases registered against him pending and Only if he gets bail in all registered cases, he will get released on bail.
16) CPIM or DYFI in Kerala has not even protested for Malayalees accused in Bhima Koregaon Case, Rona Wilson & Dr Hany Babu in Kerala. SFI has not even protested for students Allan and Thwaha but they stood for Fr.Stan
